FAQs:
What if the business already has one or more domain name, or copyrighted or patented materials?
ANSWER:
Intellectual property includes the business’s name or mark for branding purposes, plus any documentation subject to copyright.
Both trademarks and written information (employee manuals or articles written) can be publicly registered as property of the business. You will need to check to make sure everything is properly registered and that you have the right to this property when you purchase the business.
That said, certain procedures the company follows — such hiring practices — are not subject to copyright. There are also limits to names that can be “trademarked.” Strongly consider speaking with an attorney before assuming anything is — or is not — subject to intellectual protection.
